Top 10 Facts About the UAE Labor Laws
The UAE Labor Law governs all aspects of employer-employee relationships, encompassing employment contracts and related matters. It applies universally to all employees in the UAE, regardless of their nationality or expatriate status.
- Annual Leave Entitlement: Workers are entitled to annual leave on public holidays, with specific days allocated for New Year, Islamic New Year, Eid al Fitr, Eid al Adha, Arafat Day, National Day, and Commemoration Day. Annual leave duration varies based on service length.
- Regular Pay: Wages must be paid in the national currency, at the worksite, and on the workday. Monthly or annual pay package employees should receive payments at least once per month.
- Maternity Leave: Female workers with over a year of continuous service are entitled to 45 days of maternity leave with full pay. For service less than a year, leave is granted at half pay.
- Passport Retention: Employers cannot retain employees' passports without written consent.
- Visa Expenses: Employers are responsible for bearing visa expenses, and employees are not required to reimburse visa costs even upon contract termination.
- Working Hours: Adults should not work more than 8 hours a day or 48 hours a week. Extended hours are permissible in specific sectors, and reduced working hours apply during Ramadan.
- Notice Period: Resigning employees must serve the notice period or pay a compensatory amount as per the contract terms.
- No Employer Consent Required for Resignation: Employees do not need employer approval to resign from their jobs.
- Gratuity Entitlement: Gratuity pay is calculated based on the most recent salary and depends on the type of contract—limited or unlimited.
- Grace Period After Visa Termination: Employees receive a 30-day grace period from contract cancellation to obtain a new residence permit or exit the country. Illegal residents face fines, deportation, or both.
